1. Acceptance of terms
These Terms of Service (“Terms") govern your access to and use of the NextDeveloper website, applications, and services (collectively, the “Services”), operated by NextDeveloper Inc. By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or guardian. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.
3. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at nextdeveloper@mail.com of any unauthorized use or security breach.
4. Subscriptions and payments
- Some features require a paid subscription (Pro or Teams).
- Payments are processed by Stripe and are subject to Stripe's terms and privacy policy.
- Subscriptions automatically renew unless cancelled before the renewal date.
- You can manage or cancel your subscription through the Account page or Stripe Customer Portal.
- Fees are non-refundable except where required by law or at our discretion.
5. Acceptable use
You agree not to:
- Submit malicious code, malware, or content designed to harm the Services or other users.
- Attempt to bypass tier, content-access, or code-execution controls.
- Harass, abuse, or impersonate other learners in Community spaces.
- Reverse engineer, scrape, or interfere with the Services except as permitted by law.
- Use the Services for illegal, fraudulent, or unauthorized purposes.
6. User content and portfolio publishing
You retain ownership of code, projects, and other content you create using the Services. By publishing a portfolio project to GitHub, you grant us the limited right to transmit your content to GitHub on your behalf and you agree to GitHub's terms.
We may remove or disable access to any content that violates these Terms or applicable law.
7. Intellectual property
NextDeveloper and its licensors retain all rights, title, and interest in the Services, including curriculum content, software, designs, trademarks, and logos. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial learning purposes, unless you have a commercial license from us.
8. Termination and account deletion
We may suspend or terminate your account and access to the Services for violations of these Terms, abuse, or at your request. You may delete your account through the Account page; upon deletion, we will remove your data in accordance with our Privacy Policy and applicable law.
9. Disclaimers
The Services and curriculum are provided for educational purposes and on an “as is" and “as available" basis. We do not guarantee employment, certification outcomes, or specific career results. We disclaim all warranties to the maximum extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, NextDeveloper Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services, even if advised of the possibility of such damages.
11. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.
12. Changes to these terms
We may modify these Terms from time to time. We will post the updated Terms with a revised “Last updated" date and notify you of material changes through the Services or by email. Your continued use after the effective date constitutes acceptance of the revised Terms.
